What is the Streamlined Procedure?

The IRS Streamlined Filing Compliance Procedures are a formal amnesty programme created specifically for US citizens abroad who failed to file not out of wilful evasion, but simply because they didn't know they were required to.

The Offshore version, also called SFOP, is available to expats who genuinely resided outside the US during the relevant years. It waives the 5% miscellaneous offshore penalty that applies to the domestic version.

The programme requires you to file 3 years of tax returns and 6 years of FBARs, along with a signed statement certifying your non-compliance was non-willful.

Once accepted, you are fully compliant. The IRS does not typically re-open accepted Streamlined submissions.

Important: The programme is not available once the IRS has already opened an examination of your returns. If you've received any IRS correspondence about unfiled returns, contact us immediately before doing anything else.

Do you qualify?

You're a US citizen or green card holder living outside the US.

You resided outside the US for at least one of the past 3 years and spent fewer than 35 days in the US in that year.

Your non-compliance was non-willful. You didn't know you had to file, or misunderstood the rules.

You are not currently under IRS examination for any of the relevant years.

You have a valid Social Security Number or Individual Taxpayer Identification Number.
